Breaking: Supreme Court Repudiates Bush on Gitmo

See here  for the New York Times article.  In short, the Court ruled 5-3 "that President Bush overstepped his authority in ordering military war crimes trials for Guantanamo Bay detainees."  Nice job.

The ruling said the proposed trials were illegal under U.S. law and international Geneva conventions.

is that this ruling overturned a Roberts opinion from the DC Circuit.  Fascinating dynamic to have 5 of Roberts' colleagues telling him he was wrong.

When the Supreme Court said George Bush broke the law ordering military war crimes trials for Guantanamo Bay detainees, the prisoners' lawyers broke out into that old Cuban song Guantanam-error.

That Roberts stayed out of it.  The guy has some integrity.  He must have known his view might fall, and yet he stayed out for obvious reasons.  Alito was not decent in an earlier decision on which he had a conflict of interest.

What drove this case today is a trial system.
JAG corps are outraged at to how this is being carried on.
Victory for them too.
End of the day, what will happen to the detainees.

President decides who will be the Judge and Jury.
....
You just don't see how the law plays out.
You tinker with the jury.
Could not get the evidence into court.
Geneva convention violated.
Access to evidence
Quick trial which was not evident.

Future of Getmo is questioned.
.....
Clear decision will have an effect for anti-terror
Taking of prisoner
Extraordinary rendition?
Senate has debated that ....
Administration had their own rules at Getmo...
Since 9-11
No Genevia convention...that whole philosophy is under pressure today.
Bush coming out 2 min.....Japan...
Legal standard with Geneva convention and Code of Military Justice.
Critics since 4.5 years, held without trial...
Prearranged news conference..
Not a wide open new conference...

Nobody knows better than the JAG what violation of the Conventions mean to our guys should they be held by our enemies.

Q:  What dirty little secrets are we protecting by not bringing these guys to a public court of law? 

A: We will never know until Congress re-asserts its authority.

who knows a bit about international tribunals, appeared on O'Reilly last nite.  He said that Gitmo should be put under and international court, and should be out of the US.
