Talking Points Memo is reporting that last night's photo that resulted in the green screen effect for McCain last night might actually have been a mistake:
Several readers have written in to tell me that the building is actually the main building on the campus of the Walter Reed Middle School in North Hollywood, California. And sure enough, this page on the school's website makes it pretty clear that they're correct.
Several readers have suggested that perhaps one of the tech geeks charged with setting up the audio/visual bells and whistles for the evening was tasked with getting pictures of Walter Reed Army Medical Center but goofed and got this instead.
And now TMZ is reporting that for the third time this summer (past examples here), the McCain campaign is getting called out for using copyrighted material without permission:
Ann and Nancy Wilson are pissed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.
Specifically, the Heart women are upset that the GOP has used their classic "Barracuda" as a theme song for Sarah Palin. TMZ obtained a statement from Heart's rep, who says "The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission."
How long had GOP organizers had to plan this stuff and get it right? I mean, it's not like this campaign was thrown together at the last minute. Oh, wait. Maybe it was.
UPDATE: Commenter NoDuh points out this is actually copyright offense #4. Van Halen also objected to the campaign's use of "Right Now."

I'm just playing off the line - "what part of 'illegal' don't you understand" - Republicans use about people who aren't hard-line on immigration. The fact is, as you point out, Republicans have broken just about every law in the book the past 8 years. If there were any justice in the world, Bush and Cheney (and DeLay) would be heading to jail, as would dozens more in the Bush/Cheney administration. There are so many examples, but the
Valerie Plame case takes us very close to
treason. What's the penalty for that again?

...including the Walter Reed Army Medical Center fiasco, I guess this is not surprising. Still, it's pathetically revealing of the Republicans' utter cluelessness on yet ANOTHER issue (aside from economics, health care, foreign policy, etc.) - veterans issues.

I really feel I need to emphasize what a huge screw-up this potentially was. I mean, it's not like they were aiming for one mansion or school and got another. You'd think that would be a glaring error. Shouldn't someone, at some point along the way, have looked up and said, "Hey! That's not a hospital!"

Going in to the conventions, the election was Obama's to win. He needed to reassure Hillaryland and independents that he shared their values and could be trusted to lead the future. Denver provided all the proof anyone needed. It was a huge victory for Obama.
The events of this week in Minneapolis provided no game changers. Porkbarrel Palin was not a home run, but a hit to the radical extreme base right wing of the Republican party. McCain succeeded in deepening his core support but cut himself off from any chance to broaden it. The myth of the maverick committed suicide this week, there is only Bush in pumps and Bush on the stump. McCain reinforced the McSame theme with everything he did and everything he allowed to be done in his name over the last 7 days.
Going in to the conventions, it was Obama's or McCain's election to win, Coming out, it is now clearly Obama's election to lose.

No doubt the "terrorist threat" will increase as the election approaches and unfortunately that will hurt Obama. Obama needs a cushion that he doesn't have.

She looks pretty. She looks dainty. She looks like a pretty, dainty, librarian. More importantly than her looks is how she talks. She doesn't talk tough, she talks like a parrot - repeating talking points and reading script.
I just don't see the toughness. Perhaps she is kaniving. But snakes aren't tough - their sneaky. I don't want a sneaky, kaniving VP who could very well become the President. I want someone who is honest, and tough.
Like Biden.

I read the prepared text of McCain's speech..and he only mentions Laura Bush by name. He mentions "the President" and he mentions the "41st President". Maybe the live version was a little different,..did he say "George Bush" at all or just passing references w/ 9/11?
When the soon to be "41st" gave his nominating acceptance speech in 1988, he certainly made it clear that Ronald Reagan got specific mention.

If the McCain camp hasn't already hired some really good lawyers to defend all these copyright suits, I'd be happy to recommend some attorneys! I cannot grasp why they keep making these decisions that completely disregard the law, no matter how many people come at him for it! It just makes me wonder, if this is how he is going to respect something like copyrights, what is he going to do when faced with decisions dealing with human lives?
How can we believe that they truly "vetted" Palin when they can't even pull the correct picture from the internet?? Incompetent.

When Palin was first announced they played Van Halen's "Right Now" the band instantly came out with a statement that said in no way shape or form did they support McCain and asked they not use the music again.

Under Federal copyright laws, any songs published before 1923 are considered "in the public domain" and are thereful available to be used without permission. Here are some suggestions from turn of the century, (the last one that is) and WWI era songs he might consider:

Really, my friends and I were watching the speech last night and they put that image on the screen and we couldn't figure it out. We missed the reference to Walter Reed -- thought it was a McCain house and maybe he was inviting injured veterans to stay there. Shoulda known better. Hahaha!

While I agree it's in bad taste to use a song for political function without their consent, I'm pretty sure this isn't copyright infringement. TMZ says that Heart sent a "cease and desist" letter, but I believe it was actually just a "please don't use our songs" letter - i.e. not a legal complaint. Same with Van Hagar (though the McCain Campaign's use of any Van Hagar song shows they're absolute lack of judgment).
If Karl Rove gets married, and he and his bride walk out to the reception to U2's "Beautiful Day," the DJ doesn't have to ask Bono's permission to play the song. It's "Fair Use." To my knowledge, the same situation applies here. Playing any song over the loudspeakers at an event, RNC Convention, or my backyard BBQ, is still "fair use." The artist can object but no laws have been broken (as long as the music was purchased legally).
Also, to counterbalance a bit, Brooks and Dunn filed an identical "don't use our songs" letter with the Obama Campaign for their use of "Only in America" after Obama's acceptance speech at the DNC Convention. So it cuts both ways.
The one time, that I know of, this campaign season when a campaign has actually violated copyright was when the McCain Campaign used a John Mellencamp song in a TV ad without permission. That's a genuine no-no. But they withdrew the ad and apologized to the artist, which is the proper thing to do.

I said they took the proper response to a legal action/request, not that they did the right thing.
Also, like I said, they don't need permission to play music at an event, and neither does Obama, and it cuts both ways. This is a non-issue.
Note: Disagreeing with you on legal terms is not the same as being a McCain apologist. Please do not confuse the two.
